Customer agrees to the terms and conditions declared in this Online Contract ("Contract") with respect to the goods, services and information provided by or through the Site. This Contract establishes the only agreement between the Company and Customer. The Site and its contents are intended for your personal use. Unless otherwise noted. The content (all text, images, graphics, photographs, user interfaces, trademarks, logos, artwork and other content on the Site), compilation are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights, and, the copying, reproduce, selling, broadcasting, publishing or publication by a Customer of any such content or any part of the Site without Sohomod.com permission is prohibited. Third party content providers also own copyrights. A Customer may download or copy the Site content for personal, noncommercial use only, provided that no changes in or deletion of author attribution, trademark, legend, copyright notice, or other proprietary notices shall be made. Downloading or copying Site content for other then personal, noncommercial use is strictly prohibited.
All copyrighted logos, images, catalogues, links to the original pages are used with businesses' permission.
Before any service will be provided to you, you have to open an account with Sohomod.com. After the account is opened you are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. Your account cannot be used by anybody else at any time. You may not attempt to gain unauthorized access to the Site. If you've noticed any unauthorized activity on your account, please contact us immediately! You agree to provide us with current and complete information about yourself and your billing information as prompted by the registration process. You may update this information at any time by clicking "My Account" button .
Sohomod.com accepts the following payment methods:
Normally your card will be charged within 24 hours the order was placed and confirmed with manufacture the availability of the items you've ordered. If it is order which will be delivered to you in 1-7 business days, the card will be charged in full amount of the order (including delivery charges and taxes, if apply). In any other cases (postponed delivery, backorder, special order, etc) which takes some time to set up for delivery, your card will be charged in 30% of the order (including delivery charges and taxes, if apply). The rest amount (70%) will be charged on the day, when your order is shipped and we have shipment confirmation. You'll be informed about the transactions on your credit cards and shipment information via e-mail/phone, you've provided us during registration.
Sales Taxes: We do not charge sales taxes.
Receipt: You receive on your email provided at checkout, after the transaction was approved and charched by Authorize.net system.
1. You are responsible for measuring and making sure that your purchase will fit through doorways, stairways, into elevators, etc. If it happens that you are not satisfied with the item you've received and we are interested in you as a valuable customer we want you to describe your problem more specifically by contacting us and we will try to solve the problem in a different way then taking the restocking fee. See "7.CHANGING OR CANCELING ORDERS." for details. Alternatively, you may request a refund, with a deduction of a restocking fee of 15% of the original purchase price ( We don't try to earn on the restocking fee! Restocking fee is a fee requested by manufacturer and shipping cost are the fees requested by shipping company/delivery service). Shipping charges will also be deducted from your refund.
2. You must accept delivery at the assigned date/time. In case you're not in home another delivery fee might be applied. The person who signs the delivery invoice must be the same person, whose name is assigned to the billing address. Otherwise you must have confirmation from that person, that you are authorized for delivery acceptance (Authorized person must be over 18 years old).
3. As you will be informed regarding delivery date, you must be ready for your delivery. Driver usually calls you 30-40 minutes before the delivery, though you have some time to prepare the room for accepting the delivery. Drivers cannot handle furnishings that are not listed on the delivery documents. This includes, but is not limited to, electronic components (e.g. televisions, computers, stereos). They can HELP you with that, but absolutely not obliged to do that. If you are not ready for your delivery you can accept a curb-side delivery (assembly will be canceled in this case, and if you'll need help with it, Delivery Personal might return, but additional charges may apply), otherwise delivery might be canceled and new delivery fee and date will be applied. Please be advised that drivers can't also do some custom work not connected to the furniture assembly, like hanging mirrors, wall units, shelves, etc. on the walls - it requires special insurance and will never be done as a part of furniture delivery service.
4. After the delivery is done our Drivers can provide you Help with organizing packaging or boxes the furniture was packed into, but it is NOT their responsibility to take it.
5. While we take care to avoid damaging any property while delivering furniture, which are generally heavy, we are not responsible for any accidental property damage that may occur. Please, cover the most insecure places to save your walls and floors from damages.
6. We keep the right to reject some of the orders from processing. You will be notified. Credit Card is not charged for such orders at all.
7. You have to understand that delivery furniture is not such an easy process, cause of a number of transportation, ordering from different manufactures, warehouses, etc. We try to deliver you order in the shortest period of time. We are not responsible for the delays happened beyond our control. (Specially in case with Special Order, which is more complicated for delivery, and requires additional time for production and shipment).
As we ship all items as soon as it possible, all items that ship within 2-3 business days can't be canceled once the item has been purchased. If the item you want to cancel has already been shipped it can't be canceled by you or by our Customer Center. However, you may return the item subject to that item's return policy. Read more about our "Return and Exchange Policy".
Backorders: Usually "backordered" is the item which due to its popularity placed in this category until additional inventory is received. And it's worth the wait! If your order has a backordered item you will be notified immediately.
Special Order: It is NOT the stock item. You have to understand that under "Special Order" item you asking for modified item: different then stock color and fabric, different dimensions. Saying shortly "Special Order" is an item with a different specifications then STOCK item. It requires additional time to be produced (approximately 3 months). For some manufactures the most items are special orders. Check the description of the item, to see availability of the item. Usually that apply to manufactures who doesn't have their warehouses on the territory of USA.
Product Guarantee: We stand behind all of our manufacturers' product guarantees, Time frames may vary from manufacturer to manufacture, which include but are not limited to the replacement of defective parts, missing parts, or replacement of like items. Guarantee excludes clearance/closeout items. Clearance/Closeout sales are FINAL sales, we do not provide refunds for those items.
Customer satisfaction is our top priority. And if the item you've got didn't fit as well as you hoped in your space or match your decor, if it is not what you expected. (Advice: For future shopping use our "Shopping Tips". This information is located on each page with a product.) Whatever the reason, you won't be stuck with an item you do not need or do not want. You may return your order within 7 days of receipt for an exchange or a refund of the original purchase price. Shipping charges will be deducted from your refund. Follow the steps to return your item quickly:
1) e-mail us and include the original order number, what products you are returning and your name. Or call us 1-800-520-0251.
2) wrap the package carefully. ALL RETURNED PRODUCTS MUST BE IN ORIGINAL CONDITION AND PACKAGE, otherwise additional charges may be applied. You have to understand that we are not direct manufacturers of our products, and these products have to be returned to supplier's warehouse, and without original condition and packing, they can't be. Returns not in the original packaging, or assembled items will not be accepted for return.
3) return the product using your preferred shipping method to the address we provided you with.
4) save your return tracking number and if it is possible, e-mail it to us. So we can track the return. It is important that you save the tracking number and that you insure the return package in case there any issues in transit. PLEASE NOTE: Unless the return or exchange is due to an error on our part, we cannot refund shipping and handling.
Credit will be issued to the credit card used for the original purchase.
PLEASE NOTE: WE DO NOT ACCEPT RETURNS (EXCHANGES) BASED ON COLOR ISSUES. It's beyond our power and we cannot guarantee that the item you've purchased will mach 100% color you've seen on the picture at our online store. We work with different manufactures, and we get the pictures of their production from different sources (at this point some pictures can be bright, some can be dark; the pictures are taken by different photographers). All computers have different color settings, what means that each monitor adjust color in its own way. We can advice you to read carefully the description of the item then to believe the color you see on the picture. Also we can send you color-samples or fabric-samples if you are not really sure about the color, but the additional charges may apply (you'll get a discount for this amount if you purchase the item you've asked the samples for).
Assembled Furniture cannot be returned! Mattresses, Special Orders are not refundable and are not returnable at all. See more information within item description if it is refundable or not.
If the item was damaged upon the delivery:
* Most important is that you inspect the package at the time of the delivery.
It is your responsibility to check that all items are correct and all pieces accounted for before you sign. If the product is damaged in shipping, you may choose to refuse the delivery. Please be sure to notify our Customer Service of your delivery refusal. Record the freight company's name and trailer so we may track the order back to our vendor or warehouse. Speed matters since most carriers only let us file freight claims within 48 hours of delivery.
If only part of an item is damaged, you may accept the order, note the damages, and contact us. We may be able to replace damaged pieces, but also after the claim was filed. All products properly returned under this policy are eligible for a refund, which may include an in-store credit or credit to the original payment method. If you return a product which was originally purchased with a gift certificate, you will receive an in-store credit as your refund. If you return a product that was given to you as a gift, you will receive an in-store credit as well as you refund.
